ACTION ALERT: ABC MEMBERS NEEDED TO COMPLETE U.S. DOL DAVIS-BACON
WAGE SURVEY FOR HIGHWAY CONSTRUCTION PROJECTS
WHAT: The U.S. Department of Labor is conducting a Davis-Bacon wage survey for highway con-struction projects performed in Kentucky.
WHO: The survey is for contractors and subcontractors performing work on federal, state, local, and privately owned highway projects active or ongoing between 11/4/2023 and 2/4/2025.
WHEN: The survey will open on 11/4/2024, and surveys must be submitted by 2/4/2025 for data to be included in the wage determination.

As you are likely aware, the Davis-Bacon Act requires payment of locally “prevailing” wage rates and fringe benefits to employees of contractors and subcontractors performing work on federally financed or assisted construction projects. DOL’s Wage & Hour Division is responsible for conducting surveys to establish the wage rates applicable to such projects.
Contractor participation in these surveys is crucial. Low contractor turnout in DOL’s surveys can often
result in wage rates that are not representative of the true “prevailing” rates in a given area.
Once a survey has been conducted, collected, and calculated, it is extremely difficult and expensive to
appeal and change the rates until the area is surveyed again, which has been as long as five to ten years in some cases.
The best way to fight for accurate prevailing wages is for ABC members to complete the surveys.
Members should utilize form WD-10 to respond to the survey before February 4, 2025.
The DOL is holding two two-hour briefings on the survey on Wednesday, November 6 at 9:30am EST and Thursday, November 7 at 2:30pm EST. Registration is available here.
